Terms And Conditions

This Contract sets out the terms of the contract between the customer named in the Offer (“Owner”) and SolarThoughts® Pty Ltd (“Supplier”) for supply of agreed solar PV equipment and also between the customer named in the Offer (“Owner”). The contract relates to the sale of equipment by SolarThoughts® Pty Ltd and installation of a PV solar system (“System”).

1. Purchase of System

1.1. You (“Owner”) agree to purchase and we agree to supply and install you the system or unit set out in the Offer (“System”) on and subject to the terms of the Contract.
1.2. This Contract is subject to 10 business days cooling off period under Australian consumer laws. You have a right to cancel this agreement within 10 business days from and including the day after you signed or received this agreement. Details about your additional rights to cancel this agreement are set out in the information attached to this agreement.
1.3. If we have not delivered and installed the System at the Premises within 4 weeks after the original Estimate Installation Date, and you choose to end the agreement, full refund will be processed.
1.4. Besides this, we are bound by NETCC (New Energy Tech Consumer Code) Solar Retailer Code of Conduct, which also contains rules applicable to the sale and installation of solar photovoltaic systems, and we will comply with these rules in selling you the System and installing it at the Premises. Your rights under contractual warranty are in addition to the consumer guarantees under the Australian Consumer Law and these are not excluded or replaced by this contract.
1.5. Any amendments must be signed by both parties (Owner and SolarThoughts® Pty Ltd). Equivalent methods of legal agreement other than physically signing a written contract in person are also permitted (for example, electronic acceptance).
1.6. If the Supplier intends to provide different equipment to that quoted at the point of sale, it should be signed off by the Owner.
1.7. We will endeavour to install the system within 6 weeks from the date of signing the proposal. In case of new build, if the handover date is delayed, revised price (if any) and new date of installation will be mutually agreed as per clause 1.5.

2. The Owner of the System

2.1. The Owner warrants that they own the premise.
2.2. The Owner agrees to provide all reasonable assistance required by SolarThoughts® and assigned SolarThoughts® installers to enable the installation, connection and operation of the System.

3. System

3.1. All products are subject to availability. SolarThoughts® Pty Ltd reserves the right to substitute products provided that the quality is equal to or better than the one specified.

4. Payment

4.1. Payment for the supply and installation of the System comprises two parts:

  • The assignment by the Owner to SolarThoughts® Pty Ltd of all rights to create Small Scale Technology Certificates (STCs) and any other carbon credits or point of sale rebates from the installation of the System.
  • The Out of Pocket Expense which is comprised of either a full Cash Payment before installation or a Payment Plan (3rd Party).

4.2. A deposit of 10 per cent of the Out of Pocket Expense (unless otherwise stated in offer) is due upon your acceptance of the Offer and after cooling off period. No money is payable during cooling off period. SolarThoughts® Pty Ltd will hold the deposit on and subject to the terms set out in this Contract.
4.3. The Owner must sign any documents provided by SolarThoughts® in order to transfer such rights, rebates or grants and to effect the assignment of the rights to Certificates (STCs) or carbon credits or rebates to SolarThoughts® within 30 days of the delivery of the system to the Owner (supply only) or the installation of the system (supply and install), or the value of those rights, rebates or grants will be invoiced to and become immediately payable by the Owner to SolarThoughts® Pty Ltd.
4.4. Payment of the Out of Pocket Expense is required on the signing of this Agreement or as otherwise notified by SolarThoughts®.
4.5. The Out of Pocket Expense is calculated based on information provided by the Owner and the Owner is liable for additional charges incurred if the information supplied is not complete and correct.

5. Authority to Install

5.1. You authorise SolarThoughts® and assigned installers by SolarThoughts® (and its employees, agents or contractors) to install the System which you have selected, at the address set out in the Offer.
5.2. You authorise SolarThoughts® and assigned installers by SolarThoughts® (and its employees, agents or contractors) to connect that system to the electricity grid (or to arrange for the connection of that system to the grid).
5.3. You warrant that you are the owner of the property located at the address set out in the Offer or that you have obtained all consents and approvals required to install the System at the property, including from the owner. You must ensure that SolarThoughts® and assigned installers by SolarThoughts®, and its employees, agents and contractors have sufficient access to that property, at whatever times it or they may reasonably require, in order to install the System which you have selected.
5.4. You agree to execute whatever documents for installation may require, and to take whatever other action may require, in order to permit the installation of the System you have selected, and in the case of a solar electricity system, the connection of that system to the electricity grid.
5.5. We will apply for Grid Connection Approval on your behalf. If you want to do the network application yourself, you must notify us in writing. If we are doing the network application, we will let you know the outcome promptly and in case of refusal for grid connect, full refund of deposit will be processed. Once connect reference is issued and in case of cancellation thereafter, a fee of $300 will be charged to the customer to cover administrative charges.
5.6. After Grid connection, your Energy Supplier may change your existing electricity pricing.

6. Ownership and Risk

6.1. Ownership of a System will pass to you upon the later of:
6.1.1. The date the System is installed at the address specified in the Offer; and
6.1.2. Payment in full of the Out of Pocket Expense for that package.
6.1.3. The assignment by the Owner to SolarThoughts® of all rights to create (STCs) or any equivalent environmental certificates.
6.2. Risk in the System will pass to you when that package is installed at the address shown in the Offer.

7. Termination

7.1. You or SolarThoughts® Pty Ltd may terminate the Contract if the other party materially breaches the terms of the Contract.
7.2. If you are advised either during the pre-installation site inspection (if one is conducted) or on the day of installation (if no pre-installation site inspection is conducted) that additional fees and charges are necessary to install your System you may cancel the Contract.

8. Failure to Pay

8.1. Except where you are paying under a Payment Plan, if you fail to pay any amount that is due and payable under this Contract, SolarThoughts® will be entitled to interest on the unpaid amount (both before and after judgement) at the rate applicable to judgement debts in the Supreme Court in the state or territory in which your property is located.
8.2. You will also have to pay SolarThoughts® Pty Ltd any costs associated with recovery of the unpaid amount (including, but without limitation, legal costs).

9. SolarThoughts® assigned installers and Warranties

9.1 SolarThoughts® may assign a licensed sub-contractor and warrants that the installer of a System will be suitably qualified and experienced; and will be licensed or registered.

9.2. The assigned installer from SolarThoughts® for the job will repair any damage to your property that is caused by the installer of a System provided that you notify SolarThoughts® or its assigned installers of that damage within 3 months after installation of that System.
9.3. If a battery storage system is installed by any installer or sub-contractor not assigned or approved by SolarThoughts® Pty Ltd, all installation warranties provided by SolarThoughts® Pty Ltd will be void. This is because we cannot verify the quality, safety, or compliance of third-party installations, which may directly affect or compromise the performance and safety of your solar system.

10. No Guarantee of Performance

10.1. Assigned installers for the job from SolarThoughts® warrants that, if and when any System is installed, the assigned installer will endeavour to install that package in a position that is likely to maximise the performance of that System.
10.2. The performance of a System is subject to a number of variable factors, including, but not limited to:
10.2.1. in relation to solar electricity systems – the number of hours of sunlight, cloud cover and weather patterns, the location of the System and the location of the surrounding structures and flora; and
10.2.2. SolarThoughts® Pty Ltd does not guarantee the performance of, and will accept no responsibility in the event that the performance of any solar electricity package is lower than anticipated.

11. Exclusion of Warranties and Liability

11.1. SolarThoughts® Pty Ltd does not make any representations or warranties to you in connection with any System or its installation, except for those warranties set out in this Contract and those warranties which cannot be excluded from this Contract.
11.2. To the extent permitted by law, SolarThoughts® Pty Ltd liability for breach of any express or implied condition or warranty (other than a condition or warranty implied by section 69 of the Trade Practices Act 1975 (Commonwealth)) is limited to the replacement or repair of the relevant System.

12. Carbon Credits and Rebates

12.1. The Owner agrees to and will do all things necessary to assign to SolarThoughts® Pty Ltd all rights to create STC’s and any other carbon credits or point of sale rebates from the installation of the System.
12.2. SolarThoughts® Pty Ltd, its employees, agents or contractors do not accept any responsibility for administering or the outcome of any rebate application by the Owner.
12.3. The Owner warrants that all information provided in any rebate or grant application, assignment or nomination form is true and correct.
12.4. The Owner acknowledges that, in certain circumstances, the Australian or State Government may require the repayment of a grant or rebate.
12.5. SolarThoughts® will bear no responsibility to the Owner in the event that the Owner is required to repay the grant or rebate or other benefit. In the event that SolarThoughts® is required to repay any grant or rebate or forfeit the rights to Certificates or carbon credits which has reduced the Out of Pocket Expense then the Owner must pay the amount of that grant or rebate or value of the rights forfeited on demand by SolarThoughts®.
12.6. In the event that SolarThoughts® doesn’t receive the rebate through any cause, the Owner will be required to add the discounted amount plus GST of this amount onto the Out of Pocket Expense.

13. Information and Privacy

13.1. You agree to provide SolarThoughts® & its assigned installers for the job with whatever information it may require from you in order to supply you goods and services under this Contract, and to apply for any grant, rebate or other benefit which you may be entitled to receive from the Commonwealth or State Government.
13.2. The information collected by SolarThoughts® may include “personal information” within the meaning of the Privacy Act 1988 (Cwlth). You are entitled to access this information by contacting SolarThoughts® via email or phone number shown below.
13.3. SolarThoughts® & their installers will collect information from you for the purposes of supplying goods and services under this Contract and applying for the grant, rebate or other benefit on your behalf. SolarThoughts® & assigned installers may disclose or exchange that information to or with our related bodies corporate, agents and contractors (such as installers, mail houses, data processing analysts and debt collection agencies), the relevant Government authorities and where relevant your distributor, where required to fulfil our obligations under this Contract and also for any other purpose you have consented to or as authorized by law. SolarThoughts® may also disclose your personal information to a credit reporting agency in certain circumstances.
13.4. By accepting this Contract, you consent to SolarThoughts® Pty Ltd collecting, using and disclosing your information as set out in this Contract. SolarThoughts® Pty Ltd may use any licensed and registered sub-contractor to carry out the job.

14. Nature of Contract

14.1. Nothing in this Contract obliges or otherwise requires SolarThoughts® or its appointed installers to perform any domestic building work (within the meaning of the Building Works Contracts Acts).

15. Miscellaneous

15.1. This Contract sets out the entire agreement between you and SolarThoughts® and also, between you and its appointed installers. To the extent permitted by law, all implied terms are excluded.
15.2. In this Contract, a reference to any legislation is a reference to that legislation, and any legislation that repeals or replaces it, as in force from time to time.
15.3. This Contract is governed by the laws of the State in which your property is located (as specified in the Offer).

16. Exclusions

16.1. SolarThoughts® or its appointed licensed installers will organise Energex Work Request (EWR) for your solar system to be connected to the grid. The cost of this connection is not included in the agreement. You may need to contact your Energy Provider or Energy distributor to find about the cost if any.

Installation Conditions
The installer’s vehicle, equipment and installer must have ready access to the house and the location where the new solar PV system is to be installed. All necessary council or other approvals obtained by owner.
Owner must meet with installers on site.
Panel configuration as agreed on site.
No updates of the existing electrical systems are required (unless agreed to in Offer).
Subject to site inspection.

Installation includes:

  • Installation of solar PV system and associated equipment as specified.
  • Installation of necessary circuit breakers as required by standard AS5033.
  • Cabling of solar array.
  • Placing signage as required under AS3000.
  • Booking with Power Authority to replace meter and connect the system to the grid. The cost of metering connection and possible meter upgrade are an additional expense to the Owner unless stated within the invoice.
  • Commissioning after inspection by Power Authority.

17. Refunds

17.1 If you have paid us money under this agreement, but the agreement ends for any of the following reasons before we install the System at your Premises, then when the agreement ends we will promptly refund all of the money you have paid:
(a) if we have not delivered and installed the System at the Premises within 6 weeks after the original Estimate Installation Date, and you choose to end the agreement, full refund will be processed.
(b) if we give you notice of a price increase, and you choose to end the agreement rather than accept the price increase; or
(c) Grid Connection Approval is refused.
(d) If any of the equipment quoted is unattainable and you do not agree to equipment of a similar quality to be substituted.

17.2 (a) You are entitled to terminate your contract and will be given full refund if your contract for the supply of New Energy Tech that requires physical installation and our proposal has significantly changed the installation design from that previously provided to them and they are not willing to accept the change.
(b) You are entitled to terminate your contract and will be given full refund if our contract is for the supply of New Energy Tech that requires physical installation if site conditions and circumstances beyond our control result in extra chargeable work not within the contract price and you are not willing to bear those additional costs.

18. Complaints

Making a complaint
18.1 If you have a complaint relating to the System, its installation or this agreement generally, you can make a complaint to us by:
(a) calling us on our telephone number as set out in the Quote; or
(b) giving us written notice of this, by post or email.

18.2 We will handle your complaint in accordance with our standard complaints procedures. We will acknowledge receipt of the complaint in writing no longer than 15 business days and provide update of progress. You will be provided with final response no longer than 25 business days of receipt of complaint, unless we both have agreed to a further extension.

If we have volunteered to be bound by the New Energy Tech Consumer Code (NETCC), then these procedures will comply with that Code, and with the Australian Standard on Complaints Handling AS ISO 10002-2006.

Meter, Meterbox & Switchboard Upgrade

Customers may be charged for meter and switchboard upgrades as government regulations require.

Costs for wiring or associated work required for meterbox or switchboard upgrades are not included in the quoted price and must be arranged separately.

Delivery and Installation

SolarThoughts® will make reasonable efforts to install your system in a timely manner but is not liable for delays beyond its control.

You must be present during installation or arrange for an authorized adult to be present.

Standard Installation Definition

Solar System Standard Installation: Single storey, tin roof, within a 200km radius of Brisbane CBD. Meter box upgrades are not considered standard installation.

Battery System Standard Installation: Standard installation for batteries does not include backup circuits or bollards. If the battery system is installed outdoors, customers must supply pavers if necessary.

Privacy Policy

By engaging with SolarThoughts®, you agree to provide necessary personal information for the efficient functioning of our services.

Your information may be provided to contractors, employees, and relevant authorities as required.

Product Warranties

The system comes with up to 10 years’ workmanship warranty from SolarThoughts® in conjunction with the manufacturer’s warranty.

Cooling Off Period

You are entitled to a cooling-off period of ten (10) working days, where required by law. All notifications must be received in writing.

Flexible Payment Plan

Fees and lending criteria apply for Flexible Payment Plan Options with approved applicants only.

Termination

SolarThoughts® may terminate the contract if terms are not abided by or due to delays in the process causing supplier prices to increase.

Customers may terminate the agreement within the first 10 days of the quote date.

SAA Accreditation

The use of the SAA Accreditation logo or mention of the accreditation in online promotions indicates that the installation members appointed by SolarThoughts® Pty Ltd are accredited by Solar Accreditation Australia.

Master Electrician Australia

The use of the Master Electrician Australia logo or mention in online promotions signifies that the installation members appointed by SolarThoughts® Pty Ltd are members of Master Electrician Australia.

Cheaper Home Batteries Program

The Cheaper Home Batteries Program is set to launch on 1 July 2025, aiming to make home battery systems more affordable for households and small businesses. Here’s an overview of the program:

🔋 Program Overview

  • Maximum Rebate: Up to $18,500 per battery system.
  • Discount Offered: Approximately 30% off the upfront cost of eligible battery systems.
  • Battery Capacity Eligibility: Systems with a usable capacity between 5 kWh and 50 kWh are eligible for the rebate. A 50 kWh system could save a household up to $18,500 in upfront costs.
  • Implementation: Delivered through the Small-scale Renewable Energy Scheme (SRES), administered by the Clean Energy Regulator.
